Motive now supports setting vehicle regulation mode as ‘Unregulated (non-CMV)’. Drivers need to update their application to Version 53 (or above) on the Motive Driver App to use this functionality.
Overview
The Unregulated (Non-CMV) mode supports mixed fleets with the ability to configure a vehicle as Unregulated to help ensure fleets can retain the ability to track telematics information (for example: GPS, odometers, or mileage) without impacting the Driver’s ELD outputs (for example: log PDF or output file).
Note: This is intended for ELD Drivers operating both regulated and unregulated vehicles.
Guidance for ELD Drivers using Non-CMVs
If an ELD Driver operates motor vehicles with a Gross Vehicle Weight Rating (GVWR) or Gross Combination Weight Rating (GCWR) of 10,000 pounds or less at the direction of a motor carrier, the FMCSA requires those Drivers to maintain records of Duty status and record such time operating as On-duty (not driving).
Regulations
The exemption to HOS and CDL rules for non-CMV vehicles is mentioned in both US and Canadian regulations. For more details, please visit the Exemptions to the Federal Motor Carrier Safety Regulations page and the following links to see which vehicles fall under the non-CMV definition 49 CFR 390.5 (US) and SOR/2005-313 s.1 (Canada).
Regulated vehicle mode
When a Driver is operating a vehicle in Regulated mode and is connected to the Vehicle Gateway via Bluetooth or a USB cable, the system will automatically record the vehicle's movement as "Driving" in the Vehicle Gateway outputs.
Note: This mode is intended for vehicles subject to state and federal Commercial Vehicle Regulations. This includes vehicles with a gross weight exceeding 10,000 pounds, those with a passenger capacity of 16 or more, or vehicles carrying hazardous materials, among other criteria.
Unregulated vehicle mode
In the Unregulated Vehicle mode, when a Driver operates a vehicle connected to the Vehicle Gateway via Bluetooth or a USB cable, the system will not automatically record trips as driving in the Driver's logs. Instead, Drivers can manually select any duty status within the Driver App while connected to the vehicle.
Note: This mode is intended for vehicles that are not subject to state and federal Commercial Vehicle Regulations. This category includes vehicles with a gross weight of 10,000 pounds and below, those with a passenger capacity of fewer than 16, vehicles that do not transport hazardous materials, or long haul Drivers hauling agricultural commodities within 150 air miles radius from the agricultural source.
